Warranty for EZ2, EZ2MB & EZ2MBHR models
This warranty is made by e-chair USA to original purchasers acquiring products directly from e-chair USA Office. The purchasers' remedy pursuant to this warranty is limited to repair or replacement with comparable product, which fails as a result of defect, at e-chair USA's option. This warranty shall not apply to any product which must be replaced due to normal wear and tear, negligence, abuse, misuse or which have been altered or modified by someone other than c-chair USA or its authorized representatives. This warranty is the original purchaser's sole remedy for defective product and e-chair USA shall not be liable for consequential or other damages.
e-chair USA warrants all chair frames to be free from material defects and workmanship. For the product's lifetime, e-chair USA will replace any chair frame, which, based upon e-chair USA examination, proves to be defective. Mechanical control mechanisms will be under warranty for ten (10) years. Self-skinned urethane parts, pneumatic cylinders and upholstery will be under warranty for six (6) years. Casters will be under warranty for five (5) years. Warranty is based upon an eight hour, single shift day for users weighing up to 250 pounds. Multiple users, two/three shifts reduces warranty 50%.
This warranty shall not cover labor or delivery charges and does not apply to items subjected to abuse, misuse, neglect, alteration or damage caused by shipment, storage, accident, fire, flood or act of God. There are no other warranties except as expressly provided above and e-chair USA makes no express or implied warranties of any kind with respect to the goods subject to the order. All express or implied warranties not expressly stated above, including without limitation the implied warranties of merchantability and fitness for a particular purpose are hereby disclaimed. The law of the State of Missouri will govern all transactions and/or disputes.

Terms and Conditions
- Order Information:
- All orders are required to be submitted in written form such as fax, e-mail, etc. to avoid errors or duplication. Written orders will be accepted in the form of a signed and accepted seller's proposal or in the form of a buyers purchase order. No phone orders accepted.
- Application of Standard Terms:
- Sale of product is made only on the seller's standard terms and conditions of sale, which are set forth herein. The standard terms and conditions may be modified or supplemented only by a written document signed by an authorized officer of the seller. Any terms or conditions contained in any purchase order or other form used to order goods which are different from, in addition to, or in any way inconsistent with the seller's standard terms and conditions shall be of no force or effect whatsoever.
- Taxes:
- All sales, use, excise or other applicable taxes are the buyer's responsibility and are invoiced to the buyer. If buyer claims exemption from such taxes, it is the buyer's responsibility to furnish an appropriate exemption certificate to e-chair USA.
- Changes and Cancellations:
- Orders may not be changed or cancelled, in whole or in part, after an order has been issued without the written consent of the seller. Due to manufacturing variability, changes or cancellations may be subject to additional charges. There is a 35% restocking fee for any returned items in addition to all return shipping costs.
- Delays:
- Shipping data specified in the sellers' proposal represents the seller's best estimation of approximate shipping date at the time of proposal. However, the seller shall not incur any obligation or liability to purchaser for failure to ship by a particular date unless the seller agreed to an unequivocal shipping date in a separate written document signed by sellers authorized officer. In no event shall the seller be liable for any loss or damage resulting from any delay or failure in shipment or other failure, loss or damage is the proximate result of any act not under the control of e-chair USA Office (i.e.: nature, governmental, labor strike, transportation, etc.)
- Suspension:
- In the event the purchaser defaults in any payment due to the seller, the seller shall have the right, upon notice to the purchaser, to defer or discontinue shipment of any goods permanently or until such a time as the default is corrected or the purchaser provides assurance of payment in such form, content and/or amount as the seller deems adequate.
